PHILADELPHIA – A former Staples store manager claims he was fired after requesting a leave of absence for a medical condition. 

Zeth Wentz filed a lawsuit March 28 in U.S. District Court for the Eastern District of Pennsylvania against Staples Inc. and District Manager Stephanie Lehn, alleging violations of the Americans with Disabilities Act, the Pennsylvania Human Relations Act and the Family and Medical Leave Act. 

According to the complaint, during his eight years as a general manager of Staples’ Wayne location, Wentz received performance bonuses and led the store to rank as the chain’s third-best performer, despite suffering from depression and anxiety. However, once Lehn became his district manager, the suit says she began forcing him to work 10-hour days and punch a time clock, despite being a salaried worker. When Wentz asked to take an FMLA leave of absence and requested an accommodation allowing him to work eight-hour days, he claims Lehn terminated him on June 2, 2015, for alleged lack of leadership and disregard for policies. 

Wentz seeks liquidated and compensatory damages in an amount to be determined at trial, as well as litigation costs. He is represented by attorney Christopher J. Delgaizo of Kraemer Manes & Associates LLC in King of Prussia.
